Hi all,
I too have been taken for a ride by the looks of it.
My family have taken care of autograph cards from 1949 (Grandmother,Father then me), i was asked to sell them. I chose this lot. I am trying to remain polite at the moment.
Been lied to from November, could someone advise the liquidator details of i can contact them as a first course of action.
Hopefully i can take it to the next stage soon.
Any help would be great.

Yes please remain polite. He gets quite upset if you mention family does our Andy . His of course. He won't give a toss about yours.

Hi All,
Thank you very much for the liquidators details i am very grateful.
I will try and remain polite, i have more information now i am digging that may it out of the civil arena, so hopefully i will have the last laugh.I am a dog with a bone and will not leave it. It is not the money at all.
You are very right, family business is important and needs to be dealt with.

I am again thankful I have discovered this forum with so many committed to a rightful cause against the dealings of FSA & Andy Lane. I was about to take my own through the Small Claims but I have to wait now to see what is required for a joint action. The main question in my own mind is over what stock Andy Lane still has and does it contain any of the items that have purportedly been sold. As I am a member of NARPO I have to think along those lines but I doubt at this stage whether a search of his premises would provide us with anything so tangible? I could go on but I will say I have the distinct impression that Andy Lane has not got the stomach for such a storm that is brewing and I expect a reaction hopefully in our favour. |

The guy has no assets officially . Not a pot to piss in. Of course it's alleged bollocks , but the liquidators will soon give up on that one. So you unlikely to get any money.
Realistically , he could possibly be done for wrongful treading. Which means he can't operate an auction again for some time. But as he has no assets, he won't be able to anyway,  again bollocks.
Any programmes unsold by him , will be returned by him.
That's where we are. Unless anyone can prove hard evidence of fraud , that's about all that will happen.
The number of shafted now stands at 60 and climbing . It's interesting to see the diversified number of people coming forward with their complaints.
But unless one of them is a member of the mafia, then i doubt there is little anyone can do . Keep digging for evidence . |

Received list of people owed money by this company. One Guy £41,500  A few 7000 to 3000 and quite a few in the hundreds.
It is all very very sad. If this don't kill the auction trade stone dead then i don't know what will. Even proper auction sites run by intelligent , good business people are going to feel the backlash from this surely.
To think people moan at eBay if they don't get paid after 7 days.
The world is changing fast , and we really do not know what state other companies are in . Granted they are not all run by half wits who enjoy too many holidays , but you just never know. Honest guys must be fuming at this clown . I feel for them and all people owed money. |

Reading the trading history is just bollocks.
the company was successful for a number of years. However the last four auctions were poor. All four just broke even. ( so for one year you break even and yet obtain eye watering debts ??)
no money to pay corporation tax ( so you didn't break even )
a large vendor wanted his debt settled rather than be paid in intervals ( someone wanted money that was legally theirs - the rotten bastards)
company fell victim to non payers ( this has been covered already. traded for years and then all of a sudden a huge amount of non payers. BUT the company still allowed in it's terms and conditions 120 days to pay. THINK ABOUT THAT. THE COMPANY IS IN TROUBLE WITH NON PAYERS BUT STILL ALLOWS 4 MONTHS TO SETTLE)
Surely anyone with an ounce of common sense would change this to one month or the under - bidder will be offered the items . This non payer i know is the thing they are looking into . I'd love to know the id.
As i say , it's a load of bollocks. Shoot me for accepting such gormless conditions.
"" 5. Vendor payments shall be paid no earlier that 21 days after each sale. In the unlikely event no payment has been received from the purchaser payment will not be made to the vendor until the full balance is paid by the purchaser. Items will not be released to the purchaser until full payment has been made unless by prior arrangement. If the purchaser has not settled his account by 120 (One hundred and Twenty) days after the sale the items will then be re-entered automatically into the next sale or the unpaid items purchased at actual reserve prices, under bidders will also be sort."" |

The trade will still go on Wullie. People have lost money, some substantially so by the look of it. Most folk with think "thank f*ck it wasn't me" and life will go on.
I genuinely feel for those who have lost money. I had been placed in a similar position but was lucky enough to resolve mine.
Along with a few others I was subject to fraud on here a couple of years ago, but £400 was the most that any of us lost, nothing like the amounts being quoted here. Luckily, because I alerted folk to my misfortune we were able to nip it in the bud before too many got caught out. Perhaps it's lessons learned that need to be passed on in any kind of similar circumstances.
I think others, along with myself, were aware that there must have been issues with FSA for a while because of what was going on - I was a fairly regular vendor with them because I'd always received excellent terms from Andy. Payment way before others, low commission rates etc were standard. Two sales when I didn't receive payment as previously started the alarm bells ringing and I realised he was in trouble. The extent of it has come as a major surprise.
Perhaps we need something, maybe on here, where folk can send any concerns they have about certain individuals so others can be alerted if the alarm bells start to ring again?

I agree with the general principle but I think this is something the site Admin would need to approve.
As has been said in this thread, everything said and written needs to be factual or the author and / or the site could see itself in Court. |

Agreed. As in most business dealings there is a lot of "good faith".
Just because one Auction House has had problems should not lead to conclusions that the whole sector is riddled. |

In fairness John, the poster Fistral brought the issues of FSA to the forum's attention back in May 2015. It was then widely discussed and I still remain amazed that anyone who posts/reads this forum regularly still entrusted their precious commodities to Mr Lane.
The alarm bells were ringing 12 months ago.

Has anyone actually started receiving any of their unsold items back from Lane yet?

Think that was the time I was in a self imposed exile re another member on here who has since been banned. To be fair though, there has been criticism of other auctioneers on here in the past - I remember Sportingold coming on here to defend their reputation a few years back. Other auction hosues use the site as well to advertise their wares, so perhaps it's not unsurprising that folk are reluctant in the first instance to go public with their concerns?
Think there needs to be something in place though to allow folk to voice their concerns, maybe in private, and if that one voice becomes two, three or four then the thing should become public.
Anybody?

One should voice a concern whenever the need arises following an unresolved private approach.
Had I been aware of the forum before Andy Lane got his hands on my collection, do you think I or any sane person would have persisted with him?
I know Wullie for one is pessimistic about the chances of recompense but all legal advice I've had says otherwise.
The liquidation won't cover Mr Lane when asked in a legal setting where the money has gone?
Here's a taster: What are your expenses Mr Lane? Why did you release programmes that were someone else's without payment? Therefore, do you agree you were incompetent? Therefore, we shall be seeking redress even in apportioned payments. |
