When posting about something as delicate as this, then keep your posts within the law, libel isn't something you'd want to go down. See the Blackpool & Leyton Orient message forums for what can happen.

Anything libellous doesn't affect the administrators of the forum anymore but, individual posters can be prosecuted. Admin would be required to pass on the posters personal details. So be careful.

I can understand why the thread was deleted, easier than going through deleting individual posts, but a reason as to why it was, should've been forthcoming too. Even as a warning to keep further posts within the law.

I help to moderate a Brentford message-board and this has had the same issues. Smile

It isn't an easy job! Wink

Ok.
I agree with you all that it's a shame the whole thread is gone.
What happened was I was contacted by Andy Lane through facebook.

Below are some quotes from him.

"im the former director of football sports auctions ltd that is being absolutely slated on your forum."

"i dont mind 20% of what is being said as its true and deserved. But 80% of it is purely speculation and rumor mongering. Infact alot of it is now liable."

"but photographs of me, accusations of theft, posts on my life etc should not be allowed"

I contacted Craig out of courtesy, after all it is his forum and rather than delete some posts he deleted the whole thread to save a lot of time and hassle.

I am making no comment on whether I agree or not.
As wandererpaul said.Go careful with what you put on here as it is very public.

My team, Bristol Rovers shut down their official forum a couple of years ago due to similar problems.

I do hope everyone affected gets their money or programmes back

I hope this explains why this was done.

Cheers, Jamie.

Well of course you have to have a balance . Maybe he was upset by certain things. But if people want to play the victim let me put my story.

The money i chased for 7 months then i finally was told the truth , i probably won't get it. After hours making phone calls that made me late at work . The sleeplessness nights wondering if/when i'd get paid. Tonight i woke up at 1 am and couldn't sleep after. The arguments with the wife , when i assured her i'd be paid. He tears when i told her we won't get paid. The thought that our house sale nearly collapsed . The indignity of asking family members to make up the shortfall for the deposit. The stress of paying them back in good time. The wife has give up work to look after her ill mother . So now one wage and extra debt. I'm off to work now, on a Saturday , a day i should have had off to spend with the family , but can't because i need the extra money .

So Mr Lane . Please note i am very sorry if i caused you any upset. But i hope you can see you're not the only victim in this sad case. After all you're were the one i trusted with my possessions .

I feel for you Wullie. To have to sell a personal collection and then to have the money taken away, I'd be saying the same things too. £3700 is a bloody lot of money, I understand your anger, also to see other items not returned as well.

Also feel for the others that have been duped and have lost their monies too.

It makes you angry that, as a limited company, the directors seem protected from further actions to return any monies they used that should've been paid to their clients.

I hope something comes of this and it ends in yours, and the others who are waiting, favour. However, it's unlikely. See the liquidation through and see if you can go for the Directors of the business through Civil Small Claims Court. Best of luck.

Yes that is one of the problems caused by the hasty decision to take down the entire 'auctioneers' thread (rather than pruning), as it contained a lot of useful information, and advice, with regards to the Andy Lane/ FSA case, including details of the liquidators..

They are called Absolute Recovery, based in Doncaster, and the guy who i contacted is called Stephen Penn. See here:

Alternatively try a guy there called Luke Blay. As you may know there was a creditors' meeting on Friday, which i could not get to but some of the other people on here who are owed money (there are quite a few), did.
they may be able to furnish more details about what happened.

This was the legal notice of the creditors; meeting:

Email from liquidator . "Once the company is in liquidation , all trading will cease and all websites will close . We will be monitoring the situation very carefully " .

Obviously , they don't work weekends .

Nothing will happen full stop. Unless you criticise the auctioneer , then you'll be in trouble. The business has failed and it's YOUR fault mate. Suck it up.

Trust Accounting
Bonhams operate a system of trust accounting. At all times clients' money is held in an account entirely separate from the rest of the business. Bonhams is the only international auction house to offer clients this critical safeguard

This is interesting . As far as i am aware, this incredibly is not a lawful requirement . Therefore potentially , an auctioneer rather just take his commission from the buyer and seller to pay a salary and overheads, they can legally dip into clients money , withhold payments and hope they can catch up eventually. If they can't , they just go into liquidation , and then start afresh. Food for thought if selling a collection.

Surprised there has been no word from the meeting so far.

I have heard from a couple of people at the meeting and the debt is huge.
Mind blowing huge for an auction house with no rent to pay on property , no staff to pay other than the auctioneer himself. Basically , print a few catalouges and rent a hotel function room every few month for a couple of mid week days. Where has all that money gone ??? This is what i am hearing . True or not ?Hopefully i'll know more on Tuesday.

Hire of function room at the hotel used is from £35 per day.
Maybe i'm being a bit unkind. Maybe there is more to running an auction house. But other auction houses seem to be getting on fine. This auctioneer was hardly selling 99p items. So where has all that money gone ??? Confused

Graham Budd, Sporting Gold , Robert Adcock and SportingMemorys are all doing fine. Yet Football Sports Auctions has eye watering debts. What mistakes did FSA make that the others didn't ????

I rang the liquidator today. They said to me that all stock in possession of Mr Lane is still with him and ALL items will be returned to the rightful owners within the next few weeks. So all i can do is wait and see what if anything turns up. I am hoping two very rare items are returned to me then i will call it a day on the whole sad business. If they don't turn up i will be asking questions as he promised me he still had them in his possession in February.
If they don't turn up and he hasn't sold them it's alleged theft.
If they don't turn up and he has sold them in September it's alleged fraud.
I got a feeling this will drag and drag. The liquidator sounded as if he was bored with the whole thing already. I guess that's what they do. They grind you down till you give up.
