Hi all,

More asking for advice. A private dealer on eBay has been copying pages off my web site (qpr-prog.co.uk) and then selling the images as "Prints". On my web pages I have placed at the bottom a copyright note. Do I have any rights here? Has anyone else come across this before and what happened?

You could use the "Report buyer" button on all the listings in question but I doubt it would make much difference - his listings don't claim to be original programmes

He does sell some real tat - some of the West Ham prints he sells you could pick up the actual, original programmes for less money

Great QPR site by the way - the QPR v Thames Ironworks programme from 1898 is owned by a friend of mine - it's an odd one as the players listed for Thames Ironworks are actually the Southall line up (game was played just after QPR resigned from the league and they were also having to replay a local cup game v Southall a few days later)

By the way I have a cover scan of QPR v West Ham 15 Jan 77 postponed which you don't seem to have - PM me your email address and I'll send it over - I can probably help with some of the wartime ones and the friendly 53/54 if you need that as well

He (Dave King - needamatchsheet) has done the same from my Flickr site.

Absolute arsehole thieving c**t

If you hit the Report button it doesn't seem to have a sepcific topic covering stealing images?

EDIT: Have used Copyright & Trademark - Bootleg recordings or counterfeit media - Unauthorized photocopies of printed material

Having the images on a website doesn't give you ownership of them, that still belongs to QPR and the publishers

The best you can do is watermark your images

Not quite true.

"if you take a picture of a magazine [programme], you own the copyright to that picture you took, but not to the original content within the magazine [programme]
Here's a more detailed explanation:
Copyright of the Photo:
As the person who took the photograph, you automatically own the copyright to that image.
Copyright of the Original Content:
The copyright of the magazine's [programmes] content (text, images, illustrations, etc.) belongs to the original creators and publishers, not you."

So bottom line is this gadgie shouldn't be using your photos/scans without permission, particularly if he is then using them to make profit, which probably also falls foul of the copyright holder of the programme.

That is a google response rather than actual copyright law, taking a picture of an already copyrighted images DOES NOT create a new copyright which you own

Ironically, what I posted was AI generated taking the GOV.UK website into consideration.

I'm comfortable that it's broadly correct. I take a photo of a football programme, I own the copyright of that photo, however I don't own the copyright of the programme content.

So again the bottom line is, this Dave King on eBay shouldn't be using these images and eBay needs to take action.

The other day someone is selling fridge magnets and one of them is a photo of a Manchester United team.

That image is now over 70 years old and i have an original press photo, the photo has some discoloration and a lattle damage to a corner.

I sent Ebay a copy of my original photo, his listing and my website where the scroat removed it from-he never even doctored the photo or covered up the damage-Ebay said no case to answer and he is just some nob who has a few feedbacks, so you tell me then. Watermarks are easilly removed by those who intend to procure images so they can re-sell.

I do not know what gets Ebay to EVER act in your favour?, but i guess it is now patently obvious with the woke shite and the diversity and and and you only have to scream at them about some religious tone or other woke stuff and then they would remove it, but they are their own judge and Jury.

Graeme is correct, if i take a photo of an item i own that photo irrespective of who may own the original copyright[assuming it is still in force].

I never got back on this (as I started it).

I contacted the seller and he eventually removed all of the items that he had used from my website. He has been known to do this for quite some time. The worst part was that his desciption stated that these were copies from the "original programmes" which they were clearly not.

Strangely, a bug in eBay's software - and I can tell you there have been a number of late - came up when I was trying to message the seller with a list of the items using the title given in the description. eBay thought I was trying to pass on personal information and stopped me from sending the message. Yet, sending the URL of the lots worked perfectly. I actually talked to someone (not a bot) from eBay and discussed a few of the current bugs. I rather doubt any were fixed.
