Up to now I have been pretty lucky with my sales on Ebay with only a couple of minor issues from over 4,000 sales in the last twelve months.......until this week!

I sold a good condition, original 1980's Subbuteo team in it's original box, with polystyrene packaging to a buyer with 150 feedback all ok.
A few days later, I had a case opened against me stating simply "Not as described". I messaged him asking what the problem was and received back "see case notes". Obviously "not as described" didn't tell me a lot, so I contacted him again asking for specifics, but adding that if he wasn't happy to send it back and I would refund upon receipt.

Last night I received a message telling me that he had posted it and wanted £6.45 extra refunded and that "I should be ashamed of myself". Remember at this point, I still had no idea what was wrong!
I looked at the tracking details and saw he had sent it back Next Day by 1pm Special Post and not the expected signed for service that I had sent to him at a cost of £3.90.
I took Ebay advice - Don't pay the return postage as it was not agreed, but wait until it's back with you before you contact the buyer.

1pm today it arrives - NO BOX, NO POLYSTYRENE PACKING, NO GOALKEEPER, but presented instead in a punched pocket.
With steam coming out of my ears, I was dragged away from the keyboard by the missus and instead phoned Ebay.
This is normally where it all goes down the tubes, but I was put through to their fraud team, who were really good and built up a great rapport with the guy assisting me, and we spent as much time talking about football as we did about the case!

Ebay are now looking into this buyer. They are not happy with the lack of communication when I was visibly trying to find out what the problem was and the state of play as it stands regarding the return. I got the feeling (although this obviously couldn't be said due to data protection) that they were already looking into this buyer.

The downside for me, is that I have had to refund the purchase to allow their system to open the appeal (ridiculous, I know), which could take up to three weeks to complete.
I also have ten outfield players with nobody in the sticks behind them, (which I guess must be like playing for Liverpool when Karius is in goal), no box to put them in and pretty much a useless item as opposed to a decent collectable one.

Now for the important bit.....this shyster uses the Ebay ID of oyestore and is based in Manchester.

It doesn't look like he buys programmes, but you never know, and many of us sell various other bits.
I have blocked him on my site and he can no longer purchase from me.

That's shocking mate, I'm not surprised your better half had to calm you down, I'd be incandescent with rage too. That ain't fraud, it's outright bloody theft.

Really hope eBay do the decent thing for once mate.

I posted about another dodgy buyer on a different thread only a couple of days back, nowhere near as blatant as the bare-faced crook you've unfortunately encountered, but still one that got my heckles up. I've pasted it again below.




I had the misfortune to deal with what my gut instinct told me was an obvious shyster last week.

I won't name him on here as I have no proof, but if anyone wants to add him to their "blocked list" just to be on the safe side then PM me.

I sold him a nice badge, sent it immediately as per and obtained PoP etc.
Then exactly a week later I get informed by eBay that a dispute has been opened against me, where I read about my unsatisfactory poor service and an item that never arrived.

I had no contact whatsoever from the buyer asking the usual questions, has it been sent yet, it hasn't arrived can you replace it, etc etc. Just an immediate dispute requesting a Paypal refund.

So it all seemed a bit too well rehearsed for Detective Wiggy, so I checked out his feedback and in over 200 transactions he hadn't once left feedback - not once!

So I refunded him and then reported him to eBay for misuse of Payment Protection as my instinct is that I'm not the first, and certainly won't be the last.

It's only the fact I can't actually prove it that stops me naming & shaming the apple.

We've all had stuff that doesn't arrive on occasions, it happens and you suck it up, but nothing about this guy sits right.

An update on this fiasco.

I received an e-mail this morning from Ebay where they have pretty much "washed their hands of it" despite telling me it's unacceptable!
Below (in bold) are the key lines from the e-mail:

I definitely understand were your coming from in terms of it being a possible fraudulent activity from the buyer.
In particular it falls under the broad remit of it being a "faulty return" in Ebays eyes.
The difficulty comes down to being a private vs a business seller.
Unfortunately you are a business seller and there is no cover for faulty returns in that case.
I have tried appealing this decision, but unfortunately that didn’t go to plan. Alternatively ive been down the road of trying to apply for a courtesy payment for the item, but ive been told that business sellers cant get courtesy payments for faulty returns.
I really wish I could do more as what has happened to you is not acceptable by any means.


Obviously I have responded with my version of war and peace, but it looks like it's all over bar the shouting (of which there has been plenty this morning at my end)

I don't care about the £30, initially it was about the blatant theft and now it's also about Ebay's lack of understanding.
I have asked them several questions, especially why a business seller paying in excess of £500 per month is viewed as less important than a private seller paying a tenner once in a blue moon.

As I used to collect arrears in a previous life, the thought of a trip to Manchester to confront this thief is getting more attractive by the minute.

Disgusting mate.

Probably more hassle than it's worth, but I'd be tempted to take the seller to a small claims court, and / or eBay for facilitating / aiding and abetting theft.

Their email to you is bollocks quite frankly.
The buck stops with them whether they admit it or not.

He has made 14 purchases since this transactions, but I can't see what they are.
I'd love to see if his buying history shows subbuteo players unboxed at all

(I know two wrongs don't make a right, but there's no way I'd let him stiff me and swan off scot-free, and he lives too far away for a 'personal' visit sadly, although I'd still be telling him he'll be getting one - indeed I have done, and the guy righted his wrong immediately - these cowards think they're protected sitting behind their keyboards miles & miles away, so a bit of bluff and putting the wind up them never hurts - just make sure you word it carefully and don't actually threaten him, as these types are the first to go crying to the Plod)

Pound to a penny Five, if you took him and / or eBay to small claims court, neither would bother contesting and you'd get issued your judgement on the spot.

Then you can send that nice bloke Paul from "Can't Pay We'll Take It Away" round his gaff to lift his telly.

Another one to avoid shirts get sent in clothes packaging and parcel bag so double bagged and this shirt was in mint condition basically new when packaged up then he sends this message with this image! The fact it says XXXL all over the add and he's saying he wanted an XL screams out at me as suspicious straight away. The sponsor had no damage it was mint. He's now left negative feedback and messaged me calling me a con artist because I won't refund so it will be phone call to eBay in the morning. I've had lots of returns and I'll happily give a refund if a shirts returned how I sent it but in this case I'm standing my ground he's clearly damaged this shirt himself.

Ive posted this myself on another e-bay scammers posting but ;

If an e-bay member has bought 1 or even 200 items and has sent them all back or marked as not received after the seller has already left positive feedback theres no way you can see it .. as all his posts are positive and theres no record of returns or not received ( which is another fav of a few now )

This afternoon I have received by e-mail, Ebay's final word on this subject.
Following a load of waffle, here is the main paragraph.

As this case was resolved between you both without intercession from eBay, we were unable to grant an appeal in relation to this as there is no decision to be overturned.

I sympathise with your situation where you said the returned item is not in the same condition it was sent out. However, I have reviewed the matter in cooperation with the team that specialises in these types of cases and I am sorry to inform you we cannot grant your appeal. We did not see the exact condition of the item received by your customer and as such we are not able to verify the condition it should have been returned to you in.


So, obviously they are still completely missing the point here in that I view this as theft and not faulty.
I really don't get how they can not see this.

As this has gone on for approx ten weeks now, I feel it's time to let it go now, although I will respond voicing my disgust at their conclusion and complete avoidance of the point.

Small claims court is not a path I want to go down for £30 and as I said before, it really isn't about the money.

So congratulations to oyestore for proving that it does pay to be a scumbag thief.

I am selling an item at the moment and to be honest it's going for a much higher price than expected. I placed a very large photo of both sides. I wrote condition as in photographs. I also list No returns in my profile. So if anyone complains they can bugger off.
