Post subject: Ebay Buy It Nows order cancelled |

I bought four items from a seller last night, all buy it nows. Paid promptly but woke up to find a message from the seller saying they had cancelled the order as they were meant to be auction listings not buy it nows and that they would relist them.
I contacted ebay who said all that could be done was bid or contact the seller to see if they would re consider.
Has this happened to anyone else and if so what was the outcome?

Bloody annoying. But you have told us only half the story.
Sellers using BIN either have a stock or its the junk they cannot get rid of.
Have they relisted yet and did they start at the same price as their BIN price? if they put the starting price higher then please 'name and shame'.
if you do bid then I hope you would not go higher than the original BIN price. Don't let the buggers win. |

I have had similar in the past from one seller. The excuse was not it should have been listed as an auction, but listed in error. This has happened to me at least twice from the same seller. I also know of two other buyers this has happened to with the same seller. I guess that when buy it nows sell within an hour or so of listing, the seller thinks it must have been listed too cheap. Despite seeing a few other items I would like I avoid this seller and will not buy from them. |

In the basic laws of contract, the vendor has offered a price, your offer has been accepted, and you have paid the “consideration”. It’s all over it’s yours!
The vendor is in breach of contract , trying to rescind.
Clearly they are ignorant of this.
Whether they have made an honest mistake or not, they are obliged to send on the item.
I accept that low value items are not worth the hassle.
It’s all pretty basic stuff.... |

Thank you for the replies.
The relisted price was the same as the price I purchased them for originally.
Ebay informed me that there will be higher listing fees for future items they sell, unfortunately that is all that will be done. So I'm not sure how the laws of contract have been applied by ebay as the seller clearly has the items.
They finish tomorrow, so let's see what happens. _________________ Big city lights don't bother me, Northampton Town I'm proud to be.

Ebay will do nothing to discourage such buyers.
I recently sold an old boxing poster, but the guy never paid. I can't even give him poor feedback to discourage others from letting him bid on their items. Even if I give him "positive feedback" status it doesn't allow me to then put any kind of disparaging comment in. Customer service at said organisation is a complete and utter joke. |
